Divorce records are legal documents. These can be used in various ways. One of which it can be very beneficial is in the case of remarriage where the past marital union is made sure to have really ended. Should you wish to procure a record of divorce in New York, you can do so by requesting it from the Office of the Vital Records. The New York State Department of Health oversees the Vital Statistics Office which is the central repository for vital records in the state.

Records of divorce in the State of New York come in two kinds: decrees and certificates. Decrees point out to certain conditions and terms of the separation. This type of document is usually filed in the county where the divorce was granted. Divorces recorded prior to 1963 come in decrees since there were no certificates then. Certificates of divorce, on the other hand, are confidential and are only available to the couple, immediate family, and persons authorized by them only. Divorces recorded from the year 1963 to present can be accessed through the Bureau of the Vital Statistics. However, those that were recorded prior to that can only be obtained through the Office of the County Clerk in the county where the divorce was filed.

Each copy of a divorce record in New York, either certificate or decree, is worth $15. Payment should be through check or money order made payable to the New York State Department of Health. Such fee is non-refundable regardless if the divorce record requested is found or not. In case the divorce record is not located, the office will issue a "Certificate of Failure to Find".

When appealing for a copy of a divorce record in New York, a processing fee of $15 is required. Such fee is not refundable whatever the result of the search may be. In case no divorce record is found, the fee will not be returned back to you as it applies for the search itself. In this case, a "Certificate of Failure to Find" will be issued.
